Our approach to copyright</h2>\n<p>Shift Pride exists to celebrate working people: nurses, teachers, firefighters, tradespeople, drivers, chefs and office crews. Artists, illustrators and writers are working people too, and their work deserves the same respect. Our designs are created for Shift Pride or licensed for our use, and we do not knowingly sell products that copy someone else&#8217;s artwork, photographs, logos, characters or slogans protected by copyright.</p>\n<p>Mistakes can still happen in any store that publishes many designs. This page explains how to tell us when you believe something on our site infringes your copyright, and how we respond. For trademarks, design rights and other intellectual property, see our <a href=\"/intellectual-property-policy/\">Intellectual Property Policy</a>, which covers those topics in more detail.</p>\n<h2>2. Who can send a notice</h2>\n<p>A notice may be sent by the owner of the copyright or by a person authorised to act on the owner&#8217;s behalf, such as a lawyer, agent or employee of the rights holder. If you are not the owner or an authorised agent, please ask the owner to contact us; we cannot act on third-party reports alone, although we welcome tips and will review them.</p>\n<h2>3. What a valid DMCA notice must include</h2>\n<p>Under 17 U.S.C. § 512(c)(3), a notice must be in writing and include all of the following:</p>\n<ol>\n<li>A physical or electronic signature of the copyright owner or a person authorised to act on their behalf. A typed full name at the end of an email is accepted as an electronic signature.</li>\n<li>Identification of the copyrighted work you claim has been infringed, for example a link to your original artwork, a registration number, or a description detailed enough for us to recognise it.</li>\n<li>Identification of the material on shiftpride.com that you claim is infringing, with enough information for us to find it. The full URL of each product page or image is the best way.</li>\n<li>Your contact information: name, postal address, telephone number and email address.</li>\n<li>A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent or the law.</li>\n<li>A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorised to act on the owner&#8217;s behalf.</li>\n</ol>\n<p>Incomplete notices slow everything down. If something is missing, we will reply and ask for it, but we may not be able to remove material until the notice is complete.</p>\n<h2>4. Notices sent through product reviews, social media comments or order forms may not reach the right person in time.</p>\n<h2>5. What happens after we receive a notice</h2>\n<ol>\n<li>We acknowledge receipt within 1 business day.</li>\n<li>We check that the notice contains the required elements.</li>\n<li>If it does, we remove or disable access to the identified material promptly, usually within 2 business days, while we review the claim. This includes unpublishing the product, removing the image and stopping any further printing of the design.</li>\n<li>Where the material was supplied by a designer or partner, we notify them and give them the chance to respond with a counter-notice.</li>\n<li>We tell you what action we took.</li>\n</ol>\n<p>Orders already printed and shipped before we received your notice cannot be recalled from customers, but we will tell you how many units were sold if you need that information for your claim and the law allows us to share it.</p>\n<h2>6. Counter-notices</h2>\n<p>If material you supplied was removed and you believe that was a mistake or a misidentification, you may send a counter-notice under 17 U.S.C. § 512(g)(3). It must include:</p>\n<ol>\n<li>Your physical or electronic signature.</li>\n<li>Identification of the material that was removed and where it appeared before removal.</li>\n<li>A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.</li>\n<li>Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Shiftpride may be found), and that you will accept service of process from the person who sent the original notice or their agent.</li>\n</ol>\n<p>When we receive a valid counter-notice, we forward a copy to the person who sent the original notice. We may restore the material 10 to 14 business days after that, unless the original complainant tells us they have filed a court action seeking to stop the infringement.</p>\n<h2>7. Misrepresentations</h2>\n<p>Under 17 U.S.C. § 512(f), a person who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorney fees. Please consider whether the use may be authorised or allowed by law, for example as fair use, before sending a notice. If you are unsure whether material infringes your rights, you may wish to consult a lawyer.</p>\n<h2>8. Repeat infringers</h2>\n<p>We stop working with any designer, supplier or partner who is the subject of repeated valid infringement notices, and we close customer accounts used to upload or request infringing material, in appropriate circumstances.</p>\n<h2>9. Profession designs and common phrases</h2>\n<p>Many of our designs use everyday workplace words and phrases: &#8220;night shift&#8221;, &#8220;scrub life&#8221;, &#8220;teacher mode&#8221;, &#8220;on call&#8221;, &#8220;crew&#8221;. Short phrases and common job vocabulary are generally not protected by copyright, although some may be registered as trademarks. If you believe a phrase on one of our products infringes a trademark you own, please use the process in our <a href=\"/intellectual-property-policy/\">Intellectual Property Policy</a>. We never use real hospital, school district, fire department, police agency, union or company logos or official insignia.</p>\n<h2>10. Customer-supplied content</h2>\n<p>If we ever offer personalisation, where you supply your own text or image to be printed, you must own or have permission to use what you supply. We may refuse or cancel personalised orders that appear to infringe someone else&#8217;s rights, with a full refund.</p>\n<h2>11. Notices outside the United States</h2>\n<p>We will also review copyright complaints from rights holders in Canada, Australia, New Zealand and other countries. Please send the same information listed in section 3; we will apply a substantially similar process.</p>\n<h2>12. A sample notice you can adapt</h2>\n<p>To make things easier, here is the kind of wording a complete notice usually contains. Frequently asked questions</h2>\n<h3>How quickly will the product come down?</h3>\n<p>Once a complete notice is received, we usually remove or disable access to the identified material within 2 business days, and often the same day. We acknowledge every notice within 1 business day.</p>\n<h3>Will you tell me who designed the item?</h3>\n<p>We forward your notice to the designer or partner involved so they can respond. We share their identity with you only when the law requires it, for example in response to a valid subpoena, or when they consent.</p>\n<h3>Can I ask you to remove every design that looks a bit like mine?</h3>\n<p>Copyright protects specific creative expression, not general ideas, styles or job themes. A notice should identify the specific products that copy your work. We will review each listed item carefully and in good faith.</p>\n<h3>Do you keep a copy of my notice?</h3>\n<p>Yes. We keep notices and counter-notices, along with the action taken, as part of our records. A copy of a counter-notice is sent to the original complainant as the law requires, and a copy of your notice may be shared with the person whose material was removed.</p>\n<h3>Can I withdraw a notice?</h3>\n<p>Yes. Email us from the same address with the subject &#8220;DMCA Withdrawal&#8221; and identify the original notice. If you withdraw it, we may restore the material.</p>\n<h2>14. How this fits with our other policies</h2>\n<p>Our <a href=\"/terms-of-service/\">Terms of Service</a> explain that the Shift Pride name, logo and original designs belong to us and may not be copied. This DMCA page is the reverse side of that promise: the way we protect other creators from having their work copied through our store. Our <a href=\"/intellectual-property-policy/\">Intellectual Property Policy</a> describes the design rules every product must follow before it is published, such as never using real employer, agency or school logos. Together, the three pages are meant to keep the store fair for customers, for our designers and for independent artists everywhere. If a design is removed after you bought it, our <a href=\"/returns-exchanges-policy/\">Returns &amp; Exchanges Policy</a> still lets you return it within 60 days of delivery.</p>\n<h2>15.
